Truck Driver Fatigue

In an ongoing effort to improve highway safety, the Federal Motor Carrier Safety Administration (FMCSA) regulates the number of hours truck drivers may operate to ensure that they are not driving while fatigued. Approximately 4,000 people die in large truck crashes each year and driver fatigue is considered to be the leading factor. 

The FMCSA has enacted “hours of service” laws for truck drivers in order to help put an end to fatigued driving. These laws include:

Drivers must take a 30-minute break within the first 8 hours of their shift in order to stay alert.

Drivers are required to take rest periods and are not permitted to drive beyond the 14th consecutive hour after coming on duty, following 10 consecutive hours off duty.

Truckers may not drive more than 60 hours in a 7 day period, or 70 hours in an 8 day period.  

Research on the matter demonstrates that extensive work hours without sufficient recovery time actually leads to reduced sleep and chronic fatigue. In turn, drivers tend to have slower reaction times and a reduced ability to assess situations quickly due to their fatigue. 

Like most people, truck drivers are often unable to assess their own fatigue levels and evaluate their performance on the roads accurately.  Though these rules set forth by FMCSA have been challenged in court by those who felt they weren't restrictive enough and others who found it too restrictive, the court ruled in favor of the FMCSA and the rules that have been put in place.

The rule still allows for FMCSA to grant waivers to industries or companies for specific reasons determined on a case-by-case basis.

Don’t sign any paperwork without an attorney’s go-ahead. You’ll likely receive a stack of paperwork after an insurance company contacts you. Insurance companies love to slide harmful clauses into fine print so that disoriented victims can sign their rights away. ADDITIONAL RULES AND REGULATIONS FOR TRUCK DRIVERS

While on the road, truck drivers are subject to all of the ordinary laws that pertain to any driver. To increase the safety of others on the road, truck drivers are also bound by additional rules and regulations which regulate nearly every aspect of the truck driver’s job, such as:

Requiring all large truck drivers to obtain a commercial driver’s license (“CDL); 

Setting a lower blood alcohol content level to be considered driving drunk; 

Securing cargo safely, and regulating the types of materials that a truck can carry; and

Regular maintenance of the tractor trailer.

THE DANGER OF TRUCK DRIVER FATIGUE

All of the regulations listed above are meant to protect both truck drivers and other drivers who share the road with tractor trailers. However, many truck safety advocates question the effectiveness of these rules and regulations.

A more pressing matter, according to safety experts, is truck driver fatigue. New rules implemented by The U.S. Department of Transportation’s Federal Motor Carrier Safety Administration (FMCSA) allow drivers to drive 11 hours after 10 consecutive hours off-duty. Also, drivers may not drive beyond the 14th hour after coming on-duty, following 10 hours off-duty. Similar to existing rules, drivers may not drive after being on-duty for 60 hours in a seven-consecutive-day period or 70 hours in an eight-consecutive-day period. This on-duty cycle may be restarted whenever a driver takes at least 34 consecutive hours off-duty.

Short-haul truck drivers–those drivers who routinely return to their place of dispatch after each duty tour and then are released from duty–may have an increased on-duty period of 16 hours once during any seven-consecutive-day period. The 16-hour exception takes into consideration legitimate business needs without jeopardizing safety. FMCSA estimates that without the extra two on-duty hours, the industry would be required to hire at least 48,000 new drivers, actually reducing crash-reduction benefits.

The current rule allows 10 hours of driving within a 15-hour on-duty period after eight hours of off-duty time. Also, drivers may not drive after their 15th hour on duty in a workday or after 60 hours on-duty in seven consecutive days or 70 hours on-duty in eight consecutive days.

With the pressure to deliver their loads, however, drivers often continue when prudence suggests otherwise. One in five long-haul truck drivers admitted to falling asleep at the wheel within the last month.

DON’T WAIT UNTIL IT’S TOO LATE

Whatever the circumstances of your truck accident, it’s important to seek legal help quickly, as the time to file a claim isn’t unlimited. In almost all cases, a lawsuit must be filed within a certain amount of time from the date of the accident. Truck accidents in Texas occur most frequently on the major roadways like Mopac, State Highway 130 (“SH 130”), and the I-35 corridor. The number of 18-wheeler accidents in Austin and the surrounding areas is likely to increase due to a couple of different factors.

Speed

First, the 85 mph speed limit on State Highway 130 (SH 130) is the highest speed limit in the entire country. SH 130, which runs a total of 91 miles from North Austin to Seguin was intended to alleviate the familiar gridlock on Austin roadways like Mopac and I-35. However, the increased speed limit has created problems that have led to the rise in 18-wheeler accidents.

The National Highway Traffic Safety Administration (“NHTSA”) recently reported that deadly accidents caused by 18-wheelers were on the rise nationwide. The report determined that the increasing numbers of 18-wheeler fatalities were caused by high-speed tire blow-outs and poor maintenance of commercial trucks.

Tire Blowouts

The NHTSA report specifically found that 18-wheeler truck tires are not rated to operate in excess of 81 mph. That means that there is not a single 18 wheeler in the country that is safely equipped to drive at the established speed limit on SH 130 without creating the risk of a devastating tire blow-out.

Even the trucking industry has spoken up against state and local government speed limit increases. The American Trucking Association (“ATA”) has been warning State Governments of the dangers posed by increasing speed limits beyond 65 mph for years.

“Raising speed limits at the state level is a bad idea beyond 65 mph,” -ATA executive vice president Dave Osiecki.

Of course, the industry could simply police itself and regulate the maximum speed of their trucks through the use of speed limiters, a simple and affordable device that mechanically regulates how fast a big rig can drive. Unfortunately, the industry has not taken any meaningful steps towards the use of speed limiters.

The next time you see an 18-wheeler passing you at 81+ MPH on the highway, you should know that the truck is operating outside the specifications of the very tires that are propelling it down the road. The tires could literally blow-out at any moment travelling that fast.
